Acceptance of Terms
By creating an account, accessing any Brainysaas interface, requesting a demo, or using any feature made available by Brainysaas, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
If you are using the service on behalf of a company or organization, you represent that you are authorized to bind that entity to these terms. In that case, references to “you” include both the individual user and the represented organization.

User Responsibilities

Intellectual Property
Brainysaas and its licensors retain all rights, title, and interest in the software, designs, trademarks, documentation, know-how, and related intellectual property associated with the service.
Subject to your compliance with these terms, Brainysaas grants you a limited, non-exclusive, non-transferable, revocable license to access and use the platform for internal business use during an active subscription period.
Your Content
- You retain ownership of data and content that you submit to the platform.
- You grant Brainysaas a limited right to process your content solely to provide, secure, and improve the services.
- Brainysaas does not acquire ownership rights over your proprietary business content.
Payments and Billing
Paid services are billed according to your selected plan cycle, such as monthly or annual terms, and are subject to applicable taxes unless otherwise stated in writing. You agree to provide valid billing information and keep your payment details current.
Unless specifically agreed otherwise, recurring subscriptions renew automatically at the end of each billing period. To avoid renewal, cancellation requests should be submitted before the next billing date in accordance with your account controls or support instructions.
Billing Notes
- Fees already paid are generally non-refundable, except where required by law or explicitly covered by written policy.
- Brainysaas may suspend paid features if payment fails and reasonable retry attempts are unsuccessful.

Limitation of Liability
To the maximum extent permitted by law, Brainysaas is not liable for indirect, incidental, special, consequential, or punitive damages, including lost revenue, lost profits, or business interruption arising from use of, or inability to use, the service.
Brainysaas services are provided on an “as available” basis. While we prioritize security, uptime, and quality standards, no platform can guarantee uninterrupted or error-free operation under all technical conditions.
Liability Cap
Where legally enforceable, total liability for claims related to these terms is limited to the amount paid by you to Brainysaas for the applicable service period preceding the event that gave rise to the claim.
Termination
You may stop using the services at any time. Brainysaas may suspend or terminate access when necessary to protect platform integrity, enforce these terms, comply with legal obligations, or respond to misuse, fraud, or repeated violations.
Upon termination, your right to access Brainysaas services ends, and remaining obligations that by nature should survive termination, including payment obligations, IP provisions, disclaimers, and liability limits, remain in effect.
Data After Termination
- Account data may be retained for a reasonable period in line with legal, security, and backup requirements.
- You should export required information before account closure where available.
Changes to Terms
Brainysaas may update these Terms & Conditions to reflect product changes, legal requirements, operational improvements, or security updates. Revised terms become effective from the stated “Last updated” date unless otherwise indicated.
Continued use of the services after updates indicates acceptance of the revised terms. If you do not agree with updated terms, you should discontinue use and contact support for account assistance.
